Minor Liver Donation Case: A minor boy from Uttar Pradesh wants to donate liver to his ailing father. For this he filed a petition in the Supreme Court. The court, while hearing the matter on Friday, has sought a reply from the UP government. The counsel for the minor boy told the bench that his father’s condition was very critical and this was the only way to save his life.
It was said in this petition that the minor boy is fully prepared to donate the liver to his father. His condition is critical, so a decision should be taken in the matter at the earliest. In such a situation, the court has also sought an answer from the UP government. Along with this, the Supreme Court has ordered the officer of the Health Department of UP to be present on the next date of hearing on September 12.
This petition was filed only on September 8, 2022. Keeping in view the urgency, it was heard the very next day. Now hearing in this matter is to be held on September 12. In fact, in such cases, the government has to take a quick decision in view of the patient’s condition. This is the reason why the court has sought an answer from the UP government.
Organ donation to minor not allowed
Explain that according to Indian law, a minor is not allowed to donate organs before death. According to the Government’s Transplantation of Human Organ and Tissue Rule 2014, a minor is not allowed to donate a living organ or tissue. However, organs can be donated if given a proper reason. Earlier, a similar case had come before the Bombay High Court as well. Where a 16-year-old girl wanted to donate a part of her liver to her ailing father.
